A profit Vostokenergo can be explained by purchasing low-cost coal, which comes from coal-affiliated enterprises "Komsomolets Donbas and Pavlogradugol. However, the same mines supplying coal to Dniproenergo.

Recall that a controlling Dniproenergo administered NAC ECU, but company directors - loyal to ahmetivskoyi Energy Corporation DTEK. And in March, Tymoshenko and Akhmetov, in fact, agreed to preserve the status quo.

However Donetsk oligarchs do not seem to believe we can maintain control over this company, although officials have repeatedly said DTEK seeking to participate in the privatization of the company.

"Last year they sold for Vostokenergo coal at very low prices, but for Dniproenergo - a very high because there was no certainty that they can maintain control over the company. There is such a confidence, but DTEK, it seems, continues old price policy "- said one of the market participants.

Indeed, in 2009 Dniproenergo purchased coal for tenders at a price that was slightly lower than the state. The winner of all tenders proven structures that are DTEK.

According to the Herald tender procedures, contract price in these transactions amounted to 631-633 UAH including VAT per ton of coal, ie 506 USD without VAT, or 21 hryvnia cheaper for the state.

Thus, according to NAC ECO, the first half of VAT Dniproenergo purchased 2.333 million tons of coal.

However, according to the press service of DTEK, in 2008 the cost per ton of coal was ordinary at Pavlogradugol 222.2 hryvnia at the OJSC "Komsomolets Donbas - 250.1 UAH per ton. That is, for the first half with Dniproenergo was "soiled" more than 600 million USD. While certainly not breaching that law.

However, ahmetivska company is abusing the public experience and makes henkompaniyu purchase surplus coal for thermal power plants that NAC ECO has not been placed in warehouses that are overcrowded by about 30%.

Filling storage TES Dniproenergo within norms: Prydniprovska - 77%, Krivoy Rog - 25%, Zaporizhia - 34%.

Monopolistic advantage

Symptomatic that Dniproenergo - the only state henkompaniya, which this year can afford to buy private coal.

However, sources in the NAC ECO indicate that all is not as strongly: the state companies are not obliged to buy coal only in DC "Coal of Ukraine". Another matter that buy the company, they can fuel without tendering.

Indeed, according to a Cabinet of Ministers № 285-2009-P of April 2, 2009, these enterprises' procurement coal, produced by enterprises belonging to the Ministry of Coal Industry, the procurement of one party - the state enterprise "Coal of Ukraine" without approval from the Ministry of Economy.

According to the deputy legal director of the National Chamber of Anna Grankina, the ruling only gives preference to enterprises in their desire to buy coal in DC. "Thus, a direct prohibition on tendering for procurement of coal in other businesses statute contains no" - explains the lawyer.

Moreover, as evidenced by the press-service company, DC "Coal of Ukraine" any tender offer in 2009 did not have.

Thus, the purchase of fuel in a private company is legitimate. However, it is very important, because the state is still more expensive than coal. Instead, the real private companies that could participate in the auctions could "shake up" the price of coal.

However, they did not participate in the competition, according to market participants because they could not offer the required number of marks is "P" - premium, which are 2 to 3 power Dniproenergo.

According to the analyst of investment company Dragon Capital Sergei Hyde, the vast majority of coal mark "P" in Ukraine producing state-owned companies, and Komsomolets Donbas produces almost all the private scope of this grade of coal.

Thus, the only "provocation" that could help reduce the purchase price of coal to Dniproenergo and at the same time, its losses, is contained in the antitrust laws. However, proving it to state authorities have been reluctant - at least, the current leadership of the Cabinet.
